TERMS AND CONDITIONS OF BOOKING
- Your booking is made with Ocean Drive and the signature of the Client (the person in who’s name the booking is made) on the booking form shall constitute an effective and binding contract incorporating these terms.
- Ocean Drive will confirm the booking in writing on receipt of a completed booking form and payment of deposit. The deposit is non-refundable once accepted (except in circumstances as mentioned in clause 4). The full balance of fees must be paid 6 weeks prior to the commencement date of the course. If this is not received by the period stated then Ocean Drive reserves the right to cancel the booking and offer it for resale. In such a case no refunds will be given and the Client remains liable for the balance of the fees. Bookings made less than 6 weeks prior to the commencement of the course must be accompanied by payment in full.
- Cancellation by the Client must be made in writing and is deemed to take effect upon receipt. Cancellation less than 6 weeks prior to commencement of the course date will result in forfeiture of all fees paid unless Ocean Drive is able to fill the cancelled places, in which case a full refund will be given, less the deposit, for each place filled.
- Ocean Drive reserves the right to modify, postpone or cancel any course at its discretion, particularly in the event of adverse weather conditions. In such cases Ocean Drive’s liability will be limited to the return of fees and deposits already paid, if an alternative date cannot be offered. It shall not be liable for any other loss, damage, delay or inconvenience resulting therefrom.
- Any request to alter the booking must be made in writing to Ocean Drive, which reserves the right to charge an appropriate fee for the additional work involved.
- Ocean Drive accepts no liability in the event of bad weather preventing the start or completion of a course. In the event of the vessel being unable to return to port, or any other agreed final destination due to bad weather, engine failure or any other circumstances, clients may elect to stay with the vessel at no extra charge, or make their own arrangements to return at their own expense. No refunds will be given for unused flight tickets. If this is not covered by your insurance, Ocean Drive recommends that you purchase scheduled flight tickets. Compensation will not be payable if cancellation or change by the school is brought about by "force majeure". (Refer to clause 13 for definition.)
- If a client should leave a vessel or abandon a course before the scheduled termination date and time, then no refund shall be given and any additional costs incurred will not be reimbursed.
- Ocean Drive does not accept any responsibility for loss of life, personal injury, illness, or loss or damage to the property of the Client. Ocean Drive therefore recommends that all persons booking have the appropriate insurance cover.
- The vessel provided by Ocean Drive will be fully insured against accident, third party liability and personal injury due to negligence by Ocean Drive. However in the event of "own boat" tuition, the boat owner should ensure their vessel is similarly insured. Clients will compensate Ocean Drive for any loss or damage to Ocean Drive property caused by them.
- Decisions made by the Skipper/Instructor are final in respect of the safety of the vessel and the crew, to the extent that in exceptional circumstances a client or member of the client group may be asked to leave the vessel. In such a case there will be no refund given.
- The client agrees to notify Ocean Drive of any medical conditions or illnesses (including eating disorders) that may effect them or any member of their party. The client should consult his GP if in any doubt about his fitness to take part in any course. Ocean Drive recommends that all clients obtain form E111 from the post office, which provides medical cover in EC countries.
- Force Majeure: In this agreement "force majeure" means any cause directly attributable to acts, events, non-happenings, omissions, accidents or Acts of God beyond the reasonable control of Ocean Drive (including but not limited to; strikes, lock-outs, or other labour disputes, civil commotion, riots, blockade, invasion, war, fire, explosion, sabotage, storm, collision, grounding, fog, governmental act or regulation, major mechanical or electrical breakdown) beyond the control and not caused by the negligence of Ocean Drive.
